1. Acceptance
These Terms of Use ("Terms") govern your access to and use of the website at shifalaw.com, the client portal at portal.shifalaw.com, the public booking and payment pages, and any other digital service operated by The Law Office of Shifa Soressa ("the Firm," "we," "us"). By using any of these services, you agree to these Terms. If you do not agree, please do not use the services.
These Terms work alongside our Privacy Policy, which is incorporated here by reference.
2. What the website is
shifalaw.com is the informational website of an immigration law firm. The Firm publishes content about its practice areas, attorneys, and immigration law generally, and provides means for prospective and existing clients to contact us, schedule consultations, and make payments. The portal at portal.shifalaw.com is a secure space for existing clients of the Firm to view case status, send messages, upload documents, and pay invoices.
3. Not legal advice. No attorney–client relationship.
The information on shifalaw.com is provided for general informational purposes only and is not legal advice. Reading the website, sending a message through a contact form, scheduling a consultation, or otherwise communicating with us through the website does not create an attorney–client relationship. An attorney–client relationship is established only after the Firm and the client have signed a written engagement agreement and the Firm has confirmed the engagement in writing.
Until that engagement agreement is in place, please do not send the Firm confidential or time-sensitive information through the website. Information you send before the engagement is established is not protected by the attorney–client privilege.
4. Attorney advertising
This website constitutes attorney advertising under the New York Rules of Professional Conduct. Prior results do not guarantee a similar outcome. Testimonials and case examples reflect specific facts and may not be representative of every case.
5. Eligibility
You must be at least 18 years old to create a client portal account or to engage the Firm directly. Parents or legal guardians may engage the Firm on behalf of a minor and may access the portal on the minor's behalf.
6. Client portal — accounts, access, and authorized use
The client portal is available only to existing clients of the Firm (and, where authorized, to their parents, guardians, or other designated representatives). Access is granted by a one-time email or SMS code sent to the address or phone number on file with the Firm.
By using the portal you agree:

To use it only to view and manage your own case (or a case for which the Firm has authorized you to act).

Not to share your access link, login code, or one-time passcodes with anyone other than the people the Firm has authorized.

To notify the Firm immediately if you believe someone has gained unauthorized access to your portal account.

To use the portal only for purposes related to your representation by the Firm.
The Firm may suspend or revoke portal access at any time, including upon termination of the engagement.
7. Acceptable use
You agree not to:

Use the website or portal to violate any law or regulation.

Attempt to access portions of the system you are not authorized to access, including other clients' case files, internal Firm tools, or administrative interfaces.

Probe, scan, or test the vulnerability of the website, portal, or any related infrastructure without the Firm's prior written consent.

Upload, transmit, or otherwise introduce malware, viruses, or any other malicious code.

Use any automated system (scrapers, bots, scripts) to access the website or portal, except for ordinary search-engine indexing of public pages.

Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

Interfere with or disrupt the operation of the website or portal.
8. Booking, payments, and refunds
When you book a paid consultation through portal.shifalaw.com/book, payment is processed by AffiniPay (LawPay). When you pay an invoice through portal.shifalaw.com/pay-now or a payment link, payment is processed by Square or AffiniPay (LawPay) depending on the invoice. Refund eligibility is set out in the booking confirmation and in the Firm's engagement agreement.
9. Intellectual property
The text, layout, design, logo, photographs, and other content on shifalaw.com and the portal are owned by the Firm or used by the Firm under license. You may view the website and download or print pages for your personal, non-commercial reference. You may not otherwise reproduce, distribute, modify, or create derivative works from any of the content without our prior written permission.
The Firm respects the intellectual property of others. If you believe that material on shifalaw.com infringes your copyright, please contact us at info@shifalaw.com with a written notice that complies with the Digital Millennium Copyright Act.
10. Third-party links and services
shifalaw.com and the client portal may contain links to, or be integrated with, third-party websites and services (including USCIS, EOIR, Google Calendar, Google Drive, Quo, Square, AffiniPay / LawPay, and others). The Firm does not control those third parties and is not responsible for their content, privacy practices, or availability. Your use of any third-party service is governed by that service's own terms and privacy policy.
11. Disclaimer of warranties
The website and the client portal are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. The Firm does not warrant that the website or portal will be available at any particular time, that defects will be corrected, or that the content is current or accurate (other than the Firm's case-specific records, which the Firm maintains in the ordinary course).
12. Limitation of liability
To the maximum extent permitted by law, the Firm and its attorneys, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the website or portal, or any conduct or content of any third party referenced on the website or portal.
This Section 12 does not limit the Firm's professional obligations to its clients under the New York Rules of Professional Conduct or any other applicable rules governing attorneys.
13. Indemnification
You agree to defend, indemnify, and hold harmless the Firm and its attorneys, employees, and service providers from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the website or portal. This provision does not apply to the Firm's clients with respect to the legal services we provide them.
14. Termination
We may suspend or terminate your access to the website or portal, with or without notice, if we believe you have violated these Terms, if access is no longer appropriate (for example, after the engagement ends), or for any other reason. You may stop using the website or portal at any time.
15. Governing law and venue
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the use of the website or portal will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the personal jurisdiction of those courts.
Nothing in this section requires you to litigate in New York if doing so would deprive you of a non-waivable right under the law of the state in which you reside, and nothing in this section limits any rights you may have to participate in regulatory proceedings (including before USCIS, EOIR, or state bar authorities).
16. Changes to these Terms
We may revise these Terms from time to time. The effective date at the top reflects the most recent revision. Material changes that affect existing clients will be brought to their attention through the client portal or by email. By continuing to use the website or portal after a revision takes effect, you agree to the revised Terms.
17. Severability
If any part of these Terms is held to be unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be enforced to the maximum extent permitted by law.
